The Supreme Court in Nigeria has declared Senator Ahmed Markafi’s faction of the Peoples Democratic Party, PDP the authentic leadership of the party.
The apex Court upturned the verdict of the Court of Appeal in Port Harcourt which had declared Senator Ali Modu Sheriff as the authentic national chairman of the party.
The court in the judgment held that the National Convention of the party held on May 21, 2016 was in line with the PDP constitution.
Delivering judgment, Justice Bode Rhodes Vivour held that the court was satisfied that the National Convention acted constitutionally under Article 35(5) of the PDP Constitution to appoint Senator Makarfi as the National Caretaker Committee Chairman.
The Court therefore overruled the position of the Court of Appeal, saying that the lower court was wrong to have declared Senator Sheriff as Chairman based on Article 47(c) of the PDP constitution without considering other relevant Articles in the constitution of the party.
The apex court noted with dismay that Senator Sheriff filed over 10 suits in various courts across the country on the same subject matter in a bid to be Chairman of the PDP.
Based on this, Justice Vivour cautioned Head of Courts to stop assigning cases on same subject matter to different courts.
Similarly, the panel warned judges to refrain from the temptation of accepting to hear a case they know a sister judge is presiding over and awarded the sum of N250,000 as cost against Senator Sheriff.
