The Supreme Court in Abuja has struck out an appeal by a Senatorial aspirant of the People’s Democratic Party Mr. Mbam Ojemba Chikodili Fidelis challenging the victory of Senator Sam Egwu for the Ebonyi North Senatorial Primaries held on the 28 and 29 May 2022.

In a unanimous judgment Tuesday, delivered by the five-man panel led by Justice John Inyang Okoro, the Apex court threw out the suit for lacking in merit and affirmed Senator Sam Egwu as the Ebonyi North Senatorial Candidate in the 2023 general election.

Recalled that, Mr. Fidelis who was dissatisfied with the conduct of the primaries that produced Egwu, had approached the Federal High Court in Abakaliki to seek redress but the Court struck out the matter for lack of merit.

He then appealed the judgment at the Appeal Court Enugu where his demand for retrieving the mandate from Sam Egwu equally met a waterloo as the Court upheld the judgment of the lower court.

Still not satisfied with the verdict of the Appeal Court, Mr. Fidelis again appealed the judgment at the apex court which the court Tuesday quashed, for lack of merit.

Reacting to the judgment, Counsel to Senator Egwu and the PDP, Mr. Mudiaga Erhenede applauded the judgment of the Supreme Court.
