The Supreme Court of Nigeria has permitted the Social Democratic Party, SDP and it’s 2023 Kogi State Governorship Candidate, Mr. Murtala Ajaka to examine the materials used in the state governorship election.

Recall that the Supreme Court had stayed the execution of the orders of the Court of Appeal made on 1st of March 2024 in which the inspections carried out by the petitioners was set aside.

Appeal Court sitting in Abuja had earlier over-ruled the decision of the Kogi State Governorship Election Petition Tribunal sitting also in Abuja.

However, the SDP and it’s governorship candidate, Mr. Murtala  Ajaka instructed their legal team to appeal to the Supreme Court against the orders of the Court of Appeal.

Following the application for interim stay made by the legal team of the petitioners, the Supreme Court decided the case in favour of the petitioners.

Moving the application on Thursday the 3rd of March 2024, Chief J.S.Okutepa SAN, leading Shaibu Enejoh Aruwa SAN and other lawyers, urged the Supreme Court to grant the application to avoid irreparable damages the orders of the Court of Appeal will cause the Petitioners.

The Supreme Court agreed and ordered for stay in terms of the reliefs sought in the motion filed on the 5th of March 2024.

Motion on notice has been adjourned to 11th March 2024 for hearing.
