The Action People’s Party APP has withdrawn it’s petition before the Election Petition Court challenging the election of Ahmed Tinubu as president-elect in the 2023 elections.
The All Progressives Congress APC and the Independent National Electoral Commission INEC were among the respondents in the petition.
APP announced the withdrawal on Wednesday at the resumed pre-hearing session of the court when the matter was mentioned.
APP through its counsel Obet Agu informed the court that, the application for withdrawal was filed May 9 pursuant to election petition procedures.
He asked the court to grant it leave to withdraw the petition.
Counsel to President – Elect Ahmed Tinubu Mr. Wole Olanipekum, that of All Progressives Congress APC Mr. Lateef Fagbemi and Counsel to Independent National Electoral Commission INEC Abubakar Mahmood did not oppose to the withdrawal.
The Presiding Judge, Justice Haruna Tsamani granted the withdrawal of the petition and and dismissed it.
Speaking in an interview, counsel to APP Mr Obet Agu said, he withdraw the petition based on the instructions from his client.
The Presidential Election Petition Court seating had also on May 8, dismissed the election Petition by Action Alliance AA, challenging the emergence of President – Elect Ahmed Tinubu in the 2023 elections.
Justice Haruna Tsamani dismissed the petition following a withdrawal of the petition at the commencement of the pre-hearing by counsel to Action Alliance AA, Mr. Oba Maduabuchi SAN after the matter was mention for hearing.
