U.S. judiciary thwarts Donald Trump’s election challenges

0

U.S. President Donald Trump’s reshaping of the federal judiciary has done little to help him win lawsuits challenging the election outcome, with Trump appointees rebuffing him and the U.S. Supreme Court showing little interest in getting involved.

An appeals court judge appointed by Trump, a Republican, on Friday ruled against his campaign’s effort to overturn President-elect Joe Biden’s win in Pennsylvania based on unsupported allegations of voter fraud.

Free, fair elections are the lifeblood of our democracy,” Judge Stephanos Bibas wrote on behalf of a unanimous U.S. 3rd Circuit Court of Appeals panel. “Charges require specific allegations and then proof. We have neither here.”

Two judges appointed by President George W. Bush, also a Republican, signed onto Bibas’ decision.

Bibas is one of 53 judges Trump has appointed to the federal appeals courts since 2016. By comparison, President Barack Obama appointed 55 in eight years. Trump has appointed roughly a quarter of all trial-level federal judges.

The Trump administration has been so efficient at confirming judges, but it’s a real mistake to think that just because you appointed someone they will rule in your favor in an election case,” said Jessica Levinson, a professor at Loyola Law School in Los Angeles.

Trump’s campaign and his allies, including Republican lawmakers and activists, have filed more than 40 lawsuits in state and federal courts in an effort to overturn Democrat Biden’s victory in the Nov. 3 election.

The 13 federal cases have had little success so far. Several have been withdrawn. Three, including the case Bibas heard on appeal, have been dismissed. One, concerning poll observer access in Philadelphia, resulted in a settlement after a judge rebuked Trump’s lawyers.

Ultimately, Trump’s biggest problem is his arguments are so shaky that it is hard to find a sympathetic judge, Levinson said.

“These cases are an easy way for judges to show judicial independence,” Levinson said. “These cases are so frivolous.”

In one instance, a Trump appointee dismissed a lawsuit brought by conservative lawyer Lin Wood seeking to halt certification of Biden’s victory in Georgia.

“To halt the certification at literally the 11th hour would breed confusion and disenfranchisement that I find have no basis in fact and law,” U.S. District Judge Steven Grimberg in Atlanta wrote on Nov. 19.

Trump campaign legal adviser Jenna Ellis said in a statement that the Trump campaign has been denied the opportunity to fully present its evidence in court.

“Every American who cares about our constitutional system and free and fair elections should demand a full adjudication on the merits and a remedy for the corruption that has occurred, whether in court or state legislatures,” Ellis said.

Meanwhile, the U.S. Supreme Court has for weeks sat on a request by Pennsylvania Republicans that it overturn a September decision by the state’s highest court allowing election officials to count mail-in ballots that arrived after Election Day. The Trump campaign has a pending request to intervene in that case.

Trump appointed three of the Supreme Court’s nine members: Justices Neil Gorsuch, Brett Kavanaugh and most recently Amy Coney Barrett.

Barrett joined the court a week before the election, creating a 6-3 conservative majority.

Trump repeatedly said he expected the court to decide the outcome of the election while also raising doubts, without providing evidence, that the large number of mail-in ballots used because of the coronavirus pandemic would lead to fraud.

I think this (election) will end up in the Supreme Court, and I think it’s very important that we have nine justices,” Trump told reporters at a White House event in September.

Trump struck a markedly different tone on Sunday, saying in a Fox News interview that he had an increasingly narrow path to overturning Biden’s victory in court.

“Well, the problem is, it’s hard to get into the Supreme Court,” Trump said.

Federal judges, in general, are reluctant to appear to be interfering in elections, legal experts said. And, in the case of Trump-appointed judges, their priorities may be elsewhere, like broadening protections for religious freedoms.

Just because you appoint somebody doesn’t mean that you own them,” said Carl Tobias, a law professor at the University of Richmond.

Nigeria launches Solar Power Initiative

By Golfa Francis, Abuja

Nigeria’s Rural Electrification Agency has launched a five million  Naira solar power Naija Initiative programme as part of the Federal Government’s Economic Sustainability Plan, ESP.

The ESP is a deliberate and strategic plan designed as a reaction to the COVID-19 pandemic.

The solar power Initiative is designed to provide energy access to twenty-five million un-served or underserved Nigerians.

This is one of the critical programmes intended as a strategic response to the COVID-19 pandemic, to revitalize local economies and provide clean, safe and reliable energy to Nigerians.
The initiative is a private sector-led electricity access acceleration scheme to be facilitated by a low cost loan facility from the Central Bank of Nigeria and implemented by the Rural Electrification Agency.

Earlier this year, the President Muhammadu Buhari led administration approved the Nigeria Economic Sustainability Plan (NESP) developed by the Economic Sustainability.

One of the key interventions under the NESP is the Solar Power Naija Initiative, a program that seeks to connect 5 million unserved and underserved households and businesses.

Solar Power Naija will help address the challenge of access to affordable finance through the Central Bank of Nigeria Facility which makes low-cost local currency debt available to qualified companies.

Private companies will be supported to employ more Nigerians to be able to provide services in the area of manufacturing, distribution, installation and other project management and after-sales services.

It will also leverage on the support from our donor partners such as the World Bank, USAID, SEforALL and FCDO in the areas of Data on Locations, Programme Design, Manufacturing Framework and Quality Assurance.

According to the MD/CEO of the Agency, Ahmad Salihijo, “the five million solar powers Initiative programme would crease local content in the off-grid solar value chain and facilitating the growth of the local manufacturing and assembly industry”

The programme also supports manufacturers and assemblers of solar technology to set up production facilities in Nigeria, in order to support the off-grid energy sector with about 250,000 new jobs.

As we move towards full implementation of the programme, I call on the donors to continue providing support to help in making the off-grid sector commercially viable and in making electricity available and affordable to the off-grid population. Additionally, this will further confirm our commitment to reducing our greenhouse gas emissions by 20% by 2030, when compared to the “businessas-usual” levels. Salihijo added.

He emphasized that Companies involved in the assembly/manufacturing of components of off-grid solar solutions must be 70% Nigerian owned as the entire ESP is meant to facilitate and spur local productivity.

This programme shows government commitment to supporting the private sector to develop decentralized energy solutions in locations where the grid is not viable or service is inadequate.

The MD therefore encouraged private companies to take advantage of this intervention and work with the Agency towards achieving the set targets under the programme.

He said Kano state has about 35,000 people currently under HIV treatment with viral suppression rate of over 90 percent.

“It is satisfying to know that HIV prevalence in Kano state has drastically reduced from 2.5 percent to 0.5 percent according to the 2018 report.

“However this not the time to rest on our oars or being complacent but to redouble our effort so that Kano is safe from HIV AIDS,” said the Governor.

He said the success is being achieved through commitment, robust and sustained collaboration of all stakeholders in the state including international donor agencies.

According to data, the HIV suppression level in the state via intensified treatment improved from 9,346 to 18,500 in 2019.

“Eliminating stigma and discrimination, putting people at the center, respecting people’s right, avoiding gender discrimination are key to ending the twin effect of HIV and COVID-19.”

“The twin existence of the disease is an opportunity for the world to see things differently, better, together and the only way to defeat HIV/AIDS depends on how the world responds to COVID-19,” said Ganduje.

He said the burden of HIV on women and babies in Nigeria and Sub-Sharan Africa remains a cog in the wheel of the region’s social economic development.

“The state government will continue to provide needed commodity to ensure that every woman that attends Anti-Natal is screened free of charge and if positive is placed on free treatment,” said the Governor.

Ganduje at the event empowered HIV victims to strengthen their economic powers.

The Director General Kano State Agency for the Control of Aids (KSACA) Sabitu Shanono said effective supervision of the beneficiaries will be done ensure effective and sustainable  of the gesture.

The twin existence of the disease is an opportunity for the world to see things differently better and together and the only way to defeat HIV/AIDS depends on how the world responds to COVID-19.

By Gloria Essien, Abuja

The Nigerian government has launched the National Strategic Plan for Health Promotion 2020-2024, the Knowledge Management Guideline for Health Promotion 2020-2024 and the Counseling Flip Chart on Key Household Practices and Counseling Flip Chart on Family.

While launching the documents in Abuja, the Nigerian minister of Health, Dr. Osagie Ehanire, said that the policy documents would provide guidance for the improved health of Nigerians, empowerment of individuals, families, households, groups and communities.

“The National Health Promotion Policy, 2019 is meant to actualize President Muhammadu Buhari’s vision, which is to improve the health and wellbeing of Nigerians’ through promotion of healthy lifestyle.  The launch and presentation demonstrates that the Ministry of Health is not just concerned with treating illness but also putting policy in place for attaining and sustaining good health for the citizens, so that more people can enjoy good health and fewer people falling sick.

“This landmark event to present, launch and disseminate the revised National Health Promotion Policy 2019 and its ancillary Strategic Policy Documents, is timely and desirable, because it aims to actualize Federal Government’s commitment to improving health and wellbeing of Nigerians, by highlighting options to making healthier lifestyle choices,” Dr. Ehanire said.

“Health education in communities and settings such as schools, workplace and worship centers, present an opportunity to disseminate information on health and impart life skills that promote healthy and health seeking behaviors, which remain throughout life,” the Minister said.

Dr. Ehanire also said that Health Promotion activities at national and sub-national levels are central to the Basic Minimum Package of Healthcare Services provided by the National Primary Healthcare Development Agency, coordinated by the Health Promotion Division of the Department of Family Health at the Federal Ministry of Health and supported by the National Health Promotion Forum, after the maiden National Health Promotion Policy was launched earlier in 2006.

In her remarks, the minister of women affairs, Pauline Tallen, urged the federal government to prioritise women’s health.

“Women are usually the most vulnerable in every area of life. So much attention should be given to them at all cost. The inclusion of women in health policy will go a long way as they usually do not have the economic power to afford the out of pocket expenses from health care cost,” Mrs. Tallen said.

The Minister of State for Health, Dr. Olorunnimbe Mamora while delivering the key statement said that the National Presentation, Ministerial launch and Dissemination of the National Health Promotion Policy 2019 and its Ancillary Strategic Policy Documents is timely and “an honour for Nigeria and indeed the Ministry of Health to envision that its population is equipped with adequate and effective health information; to take timely action in disease prevention and increase control over their health.”

The World Health Organisation (WHO) Country Representative in Nigeria, Dr. Walter Kazardi Mulombo, commended Nigeria for the efforts in revitalising the primary healthcare centres across the country.

The Chairman Senate Committee on Health, Dr. Ibrahim Oloriegbe, said: “As legislators, during our campaigns and interactions with all our electorates, we will be promoting health. Legislators perform the functions of legislation, representation and oversight and we use all these processes to support health promotion,” Oloriegbe said.

Other stakeholders at the launch commended the Nigerian government for the proactive initiative towards improving the health of the Nigerian people.

Temitope Mustapha, Abuja

The Nigerian government has been urged to increase awareness and reach out to communities across the country in tackling the menace of Sexual and Gender-Based Violence.

The Founder of CeCe Yara Foundation, A Child Advocacy Center, Mrs. Bola Tinubu, made the call in Abuja while addressing Journalists on the increasing cases of sexual abuse across the country.

Tinubu who stressed the need to reach out to children who are victims of such abuse, identified the provision of safe space for the victims to disclose their abuse as key to ensuring that perpetrators are held accountable.

According to her, ” a lot of children suffers sexual abuse every day, they are in millions, we need to reach out and help them, we need to provide them a safe space for them to disclose their abuse and ensure their perpetrators are held accountable”

She disclosed that a sexually abused child is a survivor who needs to be supported.

“At our child advocacy center we have a very special service, which is called the child forensic service, this allows us to elicit valuable evidential information from children in a sensitive way, we help them get information that easily corroborated by the police so that we can have valuable evidence that can allow an individual to prosecute successfully.”

She lamented the under-reporting and alteration of SGBV cases, saying in Lagos State alone, 70percent of such cases are abandoned.

They are abandoned because it is difficult for families to undergo the stress and pressure of community”.

Meanwhile, the Minister of Women Affairs, Mrs. Pauline Tallen officially launched the Abuja office of the CeCe Yara Foundation and pledged the federal government’s support to the foundation on the establishment of more centers across the country.

“One thing I applaud about Ceceyara foundation is their ability to provide Psychosocial, medical, legal services to a victim under one roof in a confidential manner,” Mrs Tallen said.

The Academy Confirms 2021 Oscars will be held ‘In-Person’

The Academy says it plans to hold the 2021 Oscars ceremony in front of a live audience on April 25, 2021, according to a new report.

The vaunted film-awards ceremony will not be a virtual experience, despite the ongoing pandemic. “The Oscars in-person telecast will happen,” a source said.

The Academy had previously pushed back the date of the ceremony by two months to April 25, 2021, with the hope that the extended time would allow more films to be seen and to qualify for the deadline.

Recent awards ceremonies have featured a blend of pre-taped and live moments, with the 2020 Emmys including footage of winners accepting the awards from their homes. Emmys host Jimmy Kimmel ran the proceedings from the audience-free Staples Centre.

A 2021 Oscars host has yet to be announced, and it’s unclear whether the Academy will follow its recent trend of not choosing an official emcee.

Hong Kong activist Joshua Wong jailed for protest

0

Joshua Wong, 24, one of Hong Kong’s most prominent democracy activists, was jailed on Wednesday for more than 13 months over an unlawful anti-government rally in 2019, the toughest and most high-profile sentence for an opposition figure this year.

Wong’s sentence comes as critics say the Beijing-backed government is intensifying a crackdown on Hong Kong’s opposition and chipping away at wide-ranging freedoms guaranteed after the former British colony returned to Chinese rule in 1997, a charge authorities in Beijing and Hong Kong reject.

Reacting to the court ruling, Britain’s foreign minister Dominic Raab urged Hong Kong and Beijing authorities to stop their campaigns to stifle the opposition.

Wong had pleaded guilty to organising and inciting an unlawful assembly near the city’s police headquarters during the height of the sometimes violent demonstrations in June last year. He faced a maximum of three years in jail.

About 100 supporters gathered quietly inside the court ahead of the sentence, while a small group of pro-Beijing people rallied outside, calling for a hefty prison sentence.

“I know the coming days will be tougher. We will hang in there,” Wong, wearing a black sweater and surgical face mask, shouted after the sentence was read out.

“It’s not the end of the fight,” Wong said later through his lawyers.

Ahead of us is another challenging battleground. We’re now joining the battle in prison along with many brave protesters, less visible yet essential in the fight for democracy and freedom for Hong Kong.”

Wong’s long-time colleagues Agnes Chow, 23, and Ivan Lam, 26, were jailed for a total of 10 and seven months, respectively, on charges linked to the same siege when thousands of protesters surrounded the police headquarters on June 21 to demand the government withdraw a now-shelved extradition bill.

Chow, who cried inside the court room on hearing her sentence, had pleaded guilty to incitement and participation in an unlawful protest, while Lam pleaded guilty to incitement.

A familiar face at democracy protests since he was a teenager, Wong was less than a year old when Hong Kong returned to Beijing 23 years ago with a guarantee of freedoms not enjoyed on the mainland, including freedom of speech and assembly.

China’s imposition of a national security law on Hong Kong on June 30 was seen as the latest blow to the city’s liberties, which are crucial for its status as a global financial hub.

“KEEP THE FAITH”

Ahead of sentencing, the district court judge read a letter from Wong’s mother to the court in which she said her son was “a young person who cares about society and is persistent in his ideals”.

Under the handover agreement in 1997, Beijing promised to maintain the free-wheeling city’s way of life for 50 years under a “one country, two systems” formula, although some fear 2047 is arriving early as authorities tighten their grip.

U.S. Senator Marsha Blackburn accused China of cracking down on human rights and destroying “any semblance of autonomy in Hong Kong.”

“Keep the faith, Joshua, you are truly an inspiration to freedom fighters everywhere,” Blackburn said in a statement.

Rights groups were swift to condemn the court ruling.

By targeting well-known activists from Hong Kong’s largely leaderless protest movement, authorities are sending a warning to anyone who dares openly criticize the government that they could be next,” said Amnesty International’s Asia-Pacific Regional Director Yamini Mishra.

Wong, Chow and Lam are all former members of political group Demosisto, which was disbanded hours before Beijing imposed the security law amid fears it could be targeted.

Hong Kong activist Sunny Cheung said Wong’s sentencing would leave a hole in the democracy movement’s fight to be heard.

“This is a big loss to the civil society. It also denotes a fact that Hong Kong is now entering a new stage if not a dark time which requires strategic adjustment in order to continue the fight for democracy,” Cheung said.

In recent months, the Hong Kong government has expelled opposition lawmakers from the legislature, disqualified pro-democracy candidates from running in a now-postponed election and arrested more than 30 people under the security legislation.

The expulsion of opposition lawmakers prompted democrats to resign en masse, leaving the legislature devoid of any opposition democrats for the first time since Hong Kong returned to Chinese rule.

Hundreds of Hong Kong activists have fled through legal or illegal channels to the democratic island of Taiwan, which Beijing regards as a renegade province that should be brought back under its sovereignty, by force if necessary.

Taiwan’s ruling Democratic Progressive Party (DPP) expressed grave concerns over the sentencing.

“The DPP emphasises that what the Chinese Communists and the Hong Kong government have done today is equivalent of declaring that Hong Kong’s freedom is dead,” it said in a statement.

Ethiopia: PM shifts focus from war to 2021 Election

0

Ethiopia’s Prime Minister, Abiy Ahmed met with political parties on Wednesday to plan next year’s election thereby shifting attention away from a month-long war in the north that was sliding into a messy guerrilla conflict.

Abiy Ahmed’s government postponed a parliamentary vote this year due to COVID-19, but Tigray region went ahead and overwhelmingly re-elected a former guerrilla movement-turned-political party the Tigray People’s Liberation Front (TPLF).

That defiance was one reason for the federal government’s military offensive against TPLF leaders from November 4.

The conflict is believed to have killed thousands of people, sent 45,000 refugees into Sudan, and jeopardised political reforms and opening since Abiy took office in 2018.

Africa’s youngest leader at 44 and the 2019 Nobel Peace Prize winner for a pact with Eritrea, Abiy was talking with political parties, civil society groups and election officials about the mid-2021 vote on Wednesday, his office said.

He took Ethiopia’s top job after nearly three decades of a TPLF-led national government, which had become increasingly repressive, jailing opponents and banning opposition parties.

Abiy removed Tigrayans from government and security posts, saying they were over-represented for an ethnic group accounting for just 6% of Ethiopia’s population. The military went in when a federal army base was ambushed in Tigray.
