Alhaji Aminu Babba DanAgundi, one of the Kano kingmakers and an appellant in the Kano Emirate tussle, has called on the Emir of Kano, Muhammadu Sanusi, to respect the restraining order granted by the Court of Appeal in Abuja.

On Friday, the Court of Appeal in Abuja granted the restraining order, preventing the enforcement of its January 10th judgment, which upheld the Kano State Government’s repeal of the 2019 Emirate Council Law. This was in response to the appeal filed by DanAgundi on behalf of the 15th Emir of Kano, Alhaji Aminu Ado Bayero, and others.

The appellate court’s January 10 judgment had overturned an earlier ruling by the Federal High Court in Kano, which nullified the Kano State Emirate Council (Repeal) Law 2024.

A three-member panel led by Justice Mohammad Mustapha set aside the judgment of Justice A. Liman, ruling that the Federal High Court lacked the jurisdiction to hear the matter. This decision upheld the removal of Bayero as the 15th Emir and validated the appointment of Sanusi Lamido Sanusi as the 16th Emir of Kano.

Dissatisfied with the ruling, DanAgundi proceeded to the Supreme Court and filed a motion for a stay of execution, which the Court of Appeal ruled upon on Friday.

In a media briefing in Kano, DanAgundi urged Emir Sanusi to respect the Appeal Court ruling by vacating the royal house and maintaining the status quo.

“Let me tell you, if for any other reason Sanusi parades himself as Emir of Kano, that is a contempt of court. And don’t think he will do it.

“So what the ruling said, is for us to maintain status quo Antebellum. Once there is a judgement and you don’t agree with that judgement, you can meet the judge and say My Lord, I want a stay of execution of the judgement. That is your right, especially when you appeal against that judgement, which I did,” he said.

He also called on security agencies to enforce the ruling and urged the people of Kano to remain law-abiding.
