A High Court in Kano state North West Nigeria has restricted the Nigeria Police Force from arresting, inviting, harassing or detaining the Chairman of the Kano State Public Complaints and Anti-corruption Commission (PCACC) Muhuyi Magaji.
Justice Sunusi Ma’aji issued the order after taking Motion Exparte together with affidavit in support duly sworn to by one Mr. Abubakar Muhammad, a litigation secretary in the law firm of Messrs. A. K. Maude and Co. dated 27th day of January, 2025.
The Kano Anti-Corruption Boss was last week arrested by the police over the alleged confiscation of Kano properties of APC National Chairman Abdullahi Ganduje.
The plaintiff in the matter are the Attorney General Of Kano State, Kano State Public Complaints and Anti Corruption Commission and Muhuyi Magaji.
The defendants in the case are the Nigeria Police Force, Inspector General Of Police, Asst. Insp. Gen. Of Police, Zone 1, Kano, Commissioner Of Police Kano State, ASP. Ahmed M. Bello and Bala Muhammad Inuwa.
The court restrained the Defendants/Respondents from taking any further steps in connection with the matter.
It also, asked parties to maintain status quo or stayall actions pending the hearing and determination of the motion on notice.
“Order of Interim Injunction is hereby granted restraining the Defendants/Respondents either by themselves, their agents, officers, privies, representatives, and assigns from further inviting, arresting, detaining, harassing the officers of the 2nd Plaintiffs/Applicants or doing such acts that would be capable of interfering with the 2nd and 3rd Plaintiffs/Applicants right generally in relation to this suit compelling him to attend to their office at Abuja or at any other location in the country on the 27th January, 2025 or any other further subsequent dates pending the hearing and determination of the motion on notice.” The court order read in part
The court slated February 10 for hearing of the motion on notice.
