NERC Commends Edo Judiciary for New Electricity Practice Directions

The Nigerian Electricity Regulatory Commission (NERC), has commended the Edo State Judiciary for adopting the Edo State High Court (Nigerian Electricity Supply Industry) Practice Directions, 2026, describing the move as a major step toward strengthening the legal and regulatory framework of the power sector.

The Practice Directions, introduced under the leadership of the Chief Judge of Edo State, Justice Daniel Iyobosa Okungbowa, came into effect on May 25, 2026.

According to the power sector Regulator, the development is the result of sustained engagement between the Commission and state judiciaries aimed at addressing litigation challenges that have long hindered the growth and efficiency of the Nigerian Electricity Supply Industry (NESI).

In a statement signed by the commission, the new Practice Directions was provided for active case management and expedited hearing of electricity market-related disputes in Edo State, southern Nigeria.

NERC also mandate parties to exhaust Alternative Dispute Resolution mechanisms before commencing court proceedings.

“Other key provisions include the recognition of electronic service of court processes through email and WhatsApp, streamlined procedures for appeals arising from decisions of the Edo State Electricity Regulatory Commission, and the establishment of a dedicated Register of Edo State Electricity Market Claims to be maintained by the court registrar,” it said.

The commission noted that appeals against regulatory decisions must now be filed within 30 days, with accelerated timelines for hearing and determination of such cases.

It also expressed optimism that the Practice Directions will improve investor confidence, strengthen regulatory enforcement, and ensure the timely resolution of disputes within the Edo State electricity market.

NERC further described the initiative as a model for other states seeking to enhance the efficiency, transparency, and effectiveness of electricity market governance in Nigeria.
